Representative Steve Drazkowski (R-21B), along with 17 other co-authors introduced legislation in the Minnesota House today that would make it illegal for a federal agent to enforce new gun restricting laws passed by the U.S. Congress and President. The bill, known as the Firearms Protection Act, or H.F. 419, is similar to bills introduced in states like Wyoming and Texas.
“Minnesotans have a right to the self-protection that firearms provide, along with a right to use a firearm for hunting and recreational shooting” said Drazkowski.
According to the bill “any new federal law designed to ban or limit any personal firearm, magazine, accessory, or ammunition or to require the registration of any firearm or firearm owner shall be unenforceable”.
“Our citizens have a Constitutionally protected right to bear arms in the 2nd Amendment, and legislators have a duty as described in the 10th Amendment to ensure that our citizens’ liberties are not taken from them by the federal government” added Drazkowski. “I’ve received thousands of e-mails and phone calls from constituents asking me to protect their rights. This bill will do just that.”
The Firearms Protection Bill was introduced at the same time that the DFL controlled House Committee on Public Safety and Crime Prevention Policy held a hearing on bills that limit Minnesotans’ rights to self-defense.
Here’s the language of the bill:
The Firearm Protection Act
A bill for an act relating to public safety; firearms; providing that any new federal law designed to ban or limit any personal firearm, magazine, accessory, or ammunition or to require the registration of any firearm or firearm owner shall be unenforceable; providing for criminal penalties; proposing coding for new law in Minnesota Statutes, chapter 624.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Section 1. [624.7192] FIREARM PROTECTION ACT.
Subdivision 1. Definition.For purposes of this section, the term “new federal firearms law” means any act, law, statute, rule, regulation, or order by or under any authority of the United States Government that:
(1) is substantially and directly or indirectly related to any personal firearm, firearm magazine, other firearm accessory, or firearm ammunition that:
(i) was owned or possessed by a resident of Minnesota on the effective date of the federal act, law, statute, rule, regulation, or order, or its pertinent provision if different, and has thereafter remained exclusively within the borders of Minnesota; or
(ii) has been, is being, or will be manufactured commercially or privately in Minnesota and thereafter remains exclusively within the borders of Minnesota; or
(2) in any manner directly or indirectly requires the registration, licensing, listing, or enrollment of any firearm described by clause (1), or the identity of any person who owns or possesses any firearm described by clause (1).
Subd. 2. State’s rights; prohibition; penalty. (a) Notwithstanding any other law, rule, regulation, or order to the contrary, no person, including but not limited to any federal, state, or local governmental official, employee, or agent, shall enforce or attempt to enforce within this state any new federal firearms law, as defined in subdivision 1.
(b) Any person, including but not limited to any federal, state, or local governmental official, employee, or agent, who knowingly violates paragraph (a) is guilty of a felony, and may be punished by up to five years imprisonment and a $5,000 fine.
Subd. 3. Enforceability; new federal firearms law. Notwithstanding any other law, rule, regulation, or order to the contrary, no new federal firearms law shall be enforceable within the borders of the state of Minnesota if it is designed or attempts in any manner:
(1) to ban or restrict any personal firearm, firearm magazine, other firearm accessory, or firearm ammunition; or
(2) to require any personal firearm, firearm magazine, other firearm accessory, or firearm ammunition, or the owner of any personal firearm, firearm magazine, other firearm accessory, or firearm ammunition, to register or be licensed, listed, or enrolled in any direct or indirect manner by or with any federal, state, or local governmental department, agency, bureau, or official.
EFFECTIVE DATE. This section, except for subdivision 2, paragraph (b), is effective the day following final enactment. Subdivision 2, paragraph (b), is effective August 1, 2013, and applies to crimes committed on or after that date.

Our next course of action must be to do away with “gun free zones,” since these seem to be a prerequisite starting point for anyone with a mental illness, long-held grudge or random suicidal thoughts to embark on a killing spree against innocents. I strongly believe the federal government and the President specifically are hell bent on ultimately confiscating our guns and liberties. Thank you and the co-authors for making a stand to secure the American right to protect ourselves and our families. Your bill would also allow Law Enforcement Officers to carry their personal weapons and not sacrifice magazine capacity. These men and women are highly trained, certified and authorized, by our state or local governments, to protect us. Many handguns uses by citizens and Law Enforcement use magazines of 10+ rounds. The proposed Federal Bill would render these self-defense handguns useless. You have my support. Thank you again.

There are nearly a million people in Minnesota whose rights you are defending. That should also seriously bother those legislators who would rather take our rights away.
The new gun control legislation proposed at either the federal or state level does nothing to reduce crime. Disarming the victims does not stop criminal behavior. Just look at Chicago, New York and Washington DC to see what happens when only the democrats have guns.
